Joint Meeting with Building Authority
December 8, 2004
Michael Gray, Chairperson, called the meeting of the Bay County Library System Board of Trustees to order at 12:00 p.m. on December 8, 2004 in the County Commission Chambers, Bay County Building.

Motion by J. Davison, seconded by H. Wetters, to approve the minutes from the November 10, 2004 regular board meeting. Motion carried

There was no public input.
LIBRARY IMPROVEMENT PROJECT
Construction Manager – Mark Paulus: Skanska USA – Mark Paulus reported that the Auburn, Sage and Pinconning Branch libraries are now complete, with several punch list items being addressed at the Sage and Pinconning Branches. During the month of November the following items were begun at the Central Library site and are continuing through December: foundations; structural steel, and underground utilities. Also during the month of December masonry work is scheduled to begin depending on weather conditions. The South Side Branch Library project is on hold at this time.
Rick Bukowski questioned if the Plexiglas that is currently installed on the entrance ramp at the Sage Branch Library was the final finish. M. Paulus explained that the Plexiglas is temporary. A decision was made at the last library board meeting to install architectural spindles to stop anyone from falling through the ramp. A final price will be submitted for approval for these spindles with installation then to follow.
Bob Redmond asked for an update on the latest environmental situation on the Central Library site. M. Paulus explained that it was discovered during excavation for the site utilities on the northwest corner, that there was an existing building, which according to B. Redmond, was the Goodyear store. There was a significant portion of this structure that had been buried and other construction was erected on top of it. B. Redmond shared this is being looked into by the Building Authority’s attorney and they have also ordered a baseline assessment to be conducted.
H. Wetters stated the contamination levels were above commercial standards and believes there should be some recourse from the previous owners.
There was a request from the Building Authority of M. Paulus to supply a copy of the punch list items for Sage and Pinconning. M. Paulus responded he would supply these lists to both the library board and Building Authority board.
Superior Change Order - M. Gray explained the change order from Superior Environmental Corporation was received after the library board’s agenda dead line and is now before the board for approval. He explained the purpose of the change order is for the oversight services on the Good Year property as just discussed.
Motion by H. Wetters, seconded by J. Davison, to approve Superior Change Order for $981 Motion carried.
Battery Park – M. Gray asked for a motion to concur with the Building Authority’s approval to request of the Bay City Planning Commission to remove the portions of Battery Park that are immediately adjacent to the Central Library from the City’s Master Plan.
Motion by H. Wetters, seconded by J. Davison for the library board to adopt the same verbiage of the Building Authority’s motion in regards to Battery Park, reflecting the library board’s support for this request. Motion carried.
Architect – Curt Welch: Fishbeck Thompson Carr & Huber – Curt Welch did not have any update to report. M. Gray asked C. Welch if there has been a response from Bruce Ellenbaas, FTC&H, regarding the meeting held last October. C. Welch stated there has not been as of today.
CONSTRUCTION INVOICES
Motion by J. Davison, seconded by D. Adcock, to approve the Construction Invoices. Motion carried.

Motion by H. Wetters, seconded by J. Davison, to receive the Construction Project Expense Summary; Construction Budget, Estimates and GMP Summary and the Capital Campaign Report. Motion carried.
UNFINISHED BUSINESS
Attorney update – Kevin Ayala reported on his conversation with Jim Hammond who has agreed to continue representing the library board during negotiations for the two, labor contracts. K. Ayala has spoken with Braun Kendrick Finkbeiner; the law firm recently hired by the Bay County Library System and has negotiated a lower hourly rate of $120 instead of $140 as was first offered by the firm. In addition to this as a goodwill gesture, they have agreed to make this rate retroactive to include previous work already done. K. Ayala would include a written agreement, listing their hourly rate and the start date of January 1, 2005 for this attorney to begin representing the library.
Motion by J. Davison, seconded by D. Adcock, to adjourn the meeting at 12:12 p.m. Motion carried.
